This session will focus on a study recently completed by the VERITAS Initiative at Santa Clara Law School and the National Association of Criminal Defense Attorneys. The report, Material Indifference: How Courts Are Impeding Fair Disclosure in Criminal Cases, examined 5 years of cases in which Brady v Maryland was litigated in federal court to (1) determine the extent to which favorable evidence is being withheld, (2) assess judicial analysis of Brady cases, and (3) consider the role of courts in promoting prosecutors’ compliance with ABA R 3.8(d).
